Fisk v. Town of Redding: Plaintiff jumped from an unfenced retaining wall (same wall as Smith trial, above) and suffered a severe leg fracture, resulting in permanent disability. Plaintiff sued the Town for nuisance, and the Town responded that the wall was not inherently dangerous, and was a reasonable use of the land given that it met applicable building codes and an alternative to a protective fence was installed at the top of a nearby embankment. Suit was brought in State Superior court in Bridgeport. The jury returned a verdict for the defendant Town.
