Smith v. Town of Redding: Plaintiff suffered a traumatic brain injury from an unfenced retaining wall and sued the Town for nuisance, claiming $3M in damages. The Town responded that the wall was not inherently dangerous given that it met applicable building codes and an alternative to a protective fence was installed at the top of a nearby embankment. Suit was brought in State Superior court in Bridgeport. The jury returned a verdict for the defendant Town.
