Brown v. Middletown (USDC – 2017): Plaintiff field suit against Middletown Police Officer Frederick Dirga. Plaintiff claimed that he was subjected to false arrest, malicious prosecution and excessive force in violation of his Fourth Amendment rights during the course of his arrest. Defendant filed a motion for summary judgment as to all claims in the plaintiff’s complaint. The Court granted summary judgment as to the false arrest and malicious prosecution claims, but held that there was a disputed issue fact as to the excessive force claim.
